It is considered that by placing an order, the General Terms and Conditions of Business and Purchase Conditions are fully accepted. By using these Internet pages, the User confirms that they are acquainted with and agree with the General Terms and Conditions of Business and Use. The holder of all rights to the Internet site nutty.hr is the trading company Fertalić račun j.d.o.o.

The Terms of Use prescribe the conditions and rules for Users and apply to the use of the Internet site nutty.hr. By using the Internet site, Users express their agreement with the General Terms and Conditions of Business and Use and agree to use the Internet site nutty.hr in accordance with them. Users are advised to familiarize themselves with these Terms before making a purchase and to regularly check them to be informed of all rights and obligations.

The right to use the Internet site is a personal right of the User and cannot be transferred in any way to other individuals or legal entities, nor is any user authorized to register other individuals or legal entities.

The contract of sale of products between the Buyer and the Seller is concluded at the moment of ordering the products.

The Buyer can only be an adult and legally competent person. Contracts on behalf of and for the account of minors and completely legally incompetent persons can be concluded by their legal representatives or guardians, and partially legally competent persons can only conclude contracts with the consent of their legal representative or guardian. For actions contrary to this provision, the Seller bears no responsibility.

The User is personally responsible for the protection of the confidentiality of passwords, where they exist as such. The User is obliged to provide accurate, complete, and valid personal data when filling out the registration form. Acting contrary to this authorizes the Seller to deny such a user access to or realization of all or part of the services offered by nutty.hr.

The User is aware that there are sometimes interruptions in services, or events that are beyond the control of Fertalić račun j.d.o.o. and accepts that Fertalić račun j.d.o.o. is not responsible for any loss of data that may occur during the transmission of information on the Internet. The User agrees and accepts that access to the Internet pages may sometimes be interrupted, temporarily unavailable, or disabled.

Fertalić račun j.d.o.o. reserves the right at any time and without prior notice, if deemed necessary, to cancel or modify the content of the General Terms and Conditions of Business, the product assortment, product prices, or the content of the Internet site nutty.hr. Therefore, Users are obliged to review the content of the General Terms and Conditions of Business before each use of the Internet site nutty.hr. Contrary action releases the Seller from any liability.

The aforementioned changes take effect upon their publication on nutty.hr.

The use of this Internet site nutty.hr is solely at the User's risk. The Seller is released from any liability for damage that may have occurred during the visit to the Internet site nutty.hr due to illegal actions of third parties, computer viruses, interruptions in communication lines, unauthorized access, inappropriate behavior, negligence, etc., and other cases for which the Seller is not responsible. The Seller is released from any liability in case circumstances arise that prevent the use of the nutty.hr Internet site. The conditions of this chapter apply to the entire content of the Internet site nutty.hr.

The Seller fully disclaims any liability for the accuracy and/or completeness of all information and content on the nutty.hr Internet site. nutty.hr reserves the right to errors in product description and image based on manufacturer information. All content posted on the Internet site is posted to facilitate the buyer's choice during purchase. We do not take responsibility for unintentional errors.

nutty.hr posts all materials, photographs, and text on the website in good faith to facilitate the buyer's choice during purchase. nutty.hr does not guarantee that product photos fully correspond to the appearance of the product itself. We do not take responsibility for possible unintentional errors in product descriptions.

The Consumer Protection Act (N.N. 41/14, 110/15) applies to the terms of business.

Značenje izraza navedenih u ovim općim uvjetima

1) Prodavatelj – trgovačko društvo Fertalić račun j.d.o.o., Milivoja Matošeca 2a,10000 Zagreb, Hrvatska

2) nutty.hr – web stranica u vlasništvu Prodavatelja

3) Kupac – svaka osoba koja je nakon pregleda i odabira proizvoda ili usluge izvršila registraciju svojih podataka te naručila proizvod ili uslugu.

4) Korisnik “nutty.hr” – svaka osoba koja web stranicu “nutty.hr” koristi u svrhu ostvarivanja kupnje proizvoda oglašenih na istoj ili dobivanja informacija o pojedinom proizvodu

5) Korištenje “nutty.hr“ – pristup stranici nutty.hr radi dobivanja informacija o sadržaju iste i/ili ostvarivanja web trgovine

6) Online kupnja ili web trgovina – ostvarivanje kupnje proizvoda putem “nutty.hr”

7) Proizvodi – svi proizvodi koji su istaknuti na “nutty.hr”, a koje je moguće kupiti putem web trgovine.

Web trgovina – sklapanje i raskid ugovora o prodaji

Predmet i komercijalna svrha Ugovora je kupovina odabranog proizvoda ili usluge putem “nutty.hr” web trgovine uz plaćanje odgovarajuće naknade – cijene toga proizvoda ili usluge. Ugovor se zaključuje sredstvima daljinske komunikacije (Ugovor sklopljen na daljinu) i to putem: internet narudžbe-web trgovina, tiskanih promidžbenih poruka s narudžbenicom, telefona s ljudskim posredovanjem.

Nakon uspješno obavljene registracije (pravilno popunjeni svi traženi podaci) na e-mail Kupca biti će dostavljena obavijest o uspješnoj registraciji. 

Proizvodi koje je moguće kupiti oglašeni su na “nutty.hr” a uz svaki proizvod navedeni su podaci o specifikaciji proizvoda, cijeni. Cijena i uvjeti dostave navedeni su pod “Načini dostave”.

Odabir željenog proizvoda vrši se spremanjem u “košaricu” klikom na link “Košarica”. Ukoliko Kupac izvrši kupnju proizvoda koji je, u međuvremenu, prodan tada će Prodavatelj kontaktirati kupca radi dogovora o daljnjem postupanju (povrat uplaćenog iznosa, kupnja drugog proizvoda ili isporuka proizvoda iste vrste kada ga Prodavatelj pribavi od svojih dobavljača). Prodavatelj, osim netom navedene obveze, ne odgovara Kupcu u opisanom slučaju po bilo kojoj osnovi.

U “košarici” se nalaze svi proizvodi koje je Kupac odabrao za kupnju zajedno sa cijenom proizvoda i cijenom dostave. Ukoliko Kupac želi nastaviti sa kupnjom odabire link “Kupi”, a sustav ga dalje automatski vodi do stranice “Narudžba” na kojoj je potrebno potvrditi podatke koje je kupac dao prilikom registracije, adrese dostave, potvrditi ili eventualno izmijeniti dostavu.

Po izvršenju naprijed navedenih koraka web trgovine i odabirom “Kupi” na stranici “Narudžba”, sustav automatski vodi Kupca na stranicu “Potvrda narudžbe”, a na kojoj se nalaze podaci o broju narudžbe, plaćanju kao i obavijest o slanju potvrdnog maila koji sadrži ponudu prodaje odabranih proizvoda te obavijest o e-mail adresi i broju telefona putem kojih Kupac može dobiti sve potrebne informacije. 

Načini plaćanja

Plaćanje na internetskoj stranici nutty.hr vrši se u eurima. Cijene su maloprodajne i izražene u eurima. 

Prodavatelj je ovlašten mijenjati cijene bez prethodne obavijesti kao što je ovlašten bez prethodne obavijesti mijenjati cijene isključivo za web shop. Također, Prodavatelj je ovlašten bez prethodne obavijesti u svakom trenutku odrediti popust, dnevne ili tjedne akcije, akcije za pojedini proizvod, grupu proizvoda i/ili za sve proizvode. Navedene pogodnosti mogu biti isključive za web kupovinu što će kupcu biti naznačeno prije same kupovine.

Neovisno od prethodne točke ovih Općih uvjeta, sva naručena roba biti će isporučena po cijenama koje su vrijedile pri izradi ponude.

Plaćanje pouzećem omogućuje vam da narudžbe podmirite prilikom same dostave na navedenu adresu odnosno tek kada proizvod vidite pred sobom. Plaćanje pouzećem moguće je kod osobnog preuzimanja robe u našem proizvodnom objektu. Plaćanje pouzećem vrši se isključivo u gotovini, dostavljaču prilikom same isporuke na navedenu adresu. U slučaju da primatelj nije u mogućnosti zaprimiti pošiljku na definiranoj dostavnoj adresi u trenutku dostave, dostavljač ostavlja obavijest o prispijeću pošiljke.
